📘 General Terms and Conditions of Stay – Hotel Arias

Hotel Arias, managed by María Hilda Arias Crespo (Tax ID: 35967106M), with registered address at Rúa Alfonso XIII, 21 – 4th Floor, Door E, 36201 Vigo (Pontevedra), Spain, sets forth the following general terms applicable to all bookings and stays at the establishment.

1. Definitions
The term client, guest, or reservation holder refers to the individual or legal entity who makes a booking, either directly or through third parties. If the booking is made by a legal entity, that entity will be considered the client.

2. Booking and Confirmation
The booking is confirmed upon payment according to the selected rate. The hotel will send written confirmation. Bookings are subject to availability and the specific conditions of each rate.

3. Payment Conditions
Payments are accepted via credit/debit card and other indicated methods. Cards must be valid, active, and sufficiently funded. For bookings with payment at the hotel, a card may be requested as a guarantee. Prices include VAT. Any applicable tourist tax will be paid at the hotel.

4. Cancellation and Modification
Conditions vary depending on the selected rate. Unless otherwise stated:
– Cancellations over 48h in advance: 100% refund
– Between 24h and 48h: 33% penalty of the first night
– Less than 24h or no-show: 100% penalty of the first night
Non-refundable rates do not allow cancellation or modification. Requests must be made in writing.

4.1 Cancellation by the Establishment

The establishment reserves the right to cancel the reservation without penalty for reasons of force majeure (such as floods, fires, natural disasters, or other unforeseeable and unavoidable events). In these exceptional cases, the client will be informed as soon as possible and fully refunded for any amounts already paid.

If the hotel is unable to fulfill a confirmed reservation due to operational reasons attributable to the establishment itself (including the inability to use the room due to third-party damage or overbooking), Hotel Arias commits to providing alternative accommodation in an establishment in the same area and of an equal or higher category, covering any difference in rate and travel costs, or to refund the client in full, according to the guest's preference and applicable legislation.

5. Timetables
Check-in: from 15:00
Check-out: until 11:00
Early or late arrivals/departures are subject to availability and may incur additional charges.

6. House Rules
Smoking is strictly prohibited inside the rooms and common areas. Failure to comply with this rule will result in an additional charge for special cleaning and deodorization. Pets are not allowed, with the exception of duly accredited guide dogs, as required by law. The rest of the other guests must be strictly respected, maintaining silence between 10:00 PM and 8:00 AM. The holding of parties, events, or any gathering that exceeds the maximum capacity of the room is strictly prohibited. Unregistered persons are not allowed access to the rooms without prior authorization from management. Minors cannot stay without being accompanied by a responsible adult. It is mandatory to respect signage, restricted areas, and internal rules. For safety reasons, the use of electrical appliances that generate heat, fire, or pose a fire risk (hot plates, heating coils, etc.) is prohibited in the rooms, except for small personal care appliances. Behavior throughout the facilities must be civic and respectful.

7. Identification and Legal Registration
In strict compliance with Spanish regulations on citizen security (Royal Decree 933/2021), the documentary registration of all guests, regardless of their age, is mandatory. At the time of check-in, all guests over 14 years of age must present an official, original, and valid identity document (ID card, passport, or equivalent document). The data of minors under 14 years of age must be mandatorily provided by the accompanying responsible adult. This data will be transmitted to the State Security Forces. The hotel will deny access to anyone who fails to comply with this legal requirement, resulting in the cancellation of their stay without the right to a refund.

8. Client Responsibility and Security
The guest will be fully responsible for any damage caused to the hotel's facilities or furniture, and must cover the costs of repair or replacement. In turn, the establishment is equipped with advanced security systems, including cameras in common areas, single-use digital access links, and internal security deadbolts in the rooms. The hotel will be responsible for guests' personal belongings in accordance with current legislation, but will not be held liable for the loss, theft, or damage of objects when this is due to force majeure or the guest's own negligence (such as failing to properly secure the door, sharing the web access link with third parties, or leaving valuables unattended in common areas). Guests are advised not to leave items of extraordinary value in their rooms without prior notification to management.

9. Data Protection
In accordance with Regulation (EU) 2016/679 (GDPR) and the Spanish Organic Law 3/2018 (LOPDGDD), we inform you that the personal data collected will be processed by Hotel Arias for the purpose of managing your reservation, providing the accommodation service, and complying with current legal obligations (including the mandatory communication of data to the State Security Forces). The client may at any time exercise their rights of access, rectification, deletion, opposition, and limitation of processing, as detailed in the Privacy Policy available on our website.

10. Travel Insurance
It is recommended to take out insurance covering cancellations, medical assistance, and loss of belongings. The hotel does not offer insurance or act as an intermediary.

11. Force Majeure
The hotel is not liable for external causes preventing service provision, such as natural events, supply outages, social conflicts, or pandemics.

12. Expulsion from the Establishment
The hotel may terminate a stay early if the client:
– Violates the rules
– Disrupts coexistence or rest
– Causes material damage
– Displays offensive, aggressive, or illegal behavior
In such cases, the client must leave the hotel without refund for unused nights.

13. Supervision and Complaints
Hotel Arias holds the Tourist Inspection Book in accordance with Galicia’s Tourism Law 7/2011, and official complaint forms as per current consumer regulations.

14. Forgotten Items
Forgotten items will be kept for 30 calendar days. After that, the hotel may dispose of them. Shipping costs are borne by the client.

15. Dispute Resolution and Jurisdiction
For the resolution of any dispute arising from these conditions, if the client is acting as a consumer, the parties shall submit to the courts and tribunals determined by the applicable consumer protection legislation. If the client is acting on behalf of a company or legal entity, both parties expressly submit to the courts and tribunals of Vigo (Pontevedra), expressly waiving any other jurisdiction that may apply to them. Furthermore, in accordance with Regulation (EU) No 524/2013, we inform you that the European Commission provides an online dispute resolution platform, available at: http://ec.europa.eu/consumers/odr/.

16. Non-Waiver
Acceptance of these conditions does not imply waiver of client rights. Failure by the hotel to enforce them at a given time does not exempt the client from compliance or imply waiver of enforcement.
